GENERAL CONDITIONS OF SALE
DEFINITION AND OBJECT OF THE CONTRACT
1.1 – This contract (“Contract”) is a distance contract pursuant to art. 50 et seq. of Legislative Decree no. 206 of 6 September 2005 (“Consumer Code”). The purpose of the Contract is the sale of movable goods between CONSERVE SICILIA SRLS (the selling company) and the consumer (the “Customer”).
The Contract is concluded directly through the acceptance of a purchase proposal issued by the Customer via the Internet, following the invitation to offer contained on the website www.palumbocreme.com (the “Site”) and/or through other distance selling systems of CONSERVE SICILIA SRLS, based on the methods described in the following article 3.
1.2 These general conditions of sale ("General Conditions") and, in particular, the information referred to in Article 52 of the Consumer Code, as provided by CONSERVE SICILIA SRLS and reported on the Site, will remain valid and effective until modified and/or supplemented by CONSERVE SICILIA SRLS. Any changes and/or additions to the General Conditions will be effective from the date they are communicated to the public and will apply to sales made from that date. The latest updated version of the General Conditions is the one available on the Site.
2. SELLING PRICES
The sales prices of the products illustrated on the Site and/or through any other distance selling systems of CONSERVE SICILIA SRLS include VAT and any other taxes.
3. PURCHASE AND PAYMENT METHODS
3.1 – The Contract is concluded by telephone by communicating to the Customer (who has contacted CONSERVE SICILIA SRLS by telephone and formulated, on that occasion, a purchase proposal, also providing the operator with the data necessary for the registration procedure of his/her name, the purchase order and the chosen payment method) that the proposal has been accepted.
3.2 – In the event of purchase proposals submitted via the Site, the Customer will receive a summary email from CONSERVE SICILIA SRLS, informing them that their purchase proposal is being processed and will be deemed accepted, unless CONSERVE SICILIA SRLS notifies otherwise by email or telephone within 3 (three) calendar days of receiving the summary email. After this period, the online Contract is deemed finalized.
3.3 – Orders will be processed within 48 hours of receiving the purchase order summary email.
3.4 – Payments can be made using the payment methods indicated on the Site
4. DELIVERY OF PRODUCTS – COMPLAINTS
4.1 – CONSERVE SICILIA SRLS delivers the products to the address indicated by the Customer within 8 working days for shipments in Italy and within 14 working days for shipments abroad (EU).
4.2 – The costs that the Customer must bear are indicated at the time of checkout and payment.

5. PRODUCT AVAILABILITY
CONSERVE SICILIA SRLS accepts Customer orders within the limits of the quantities of the requested products in stock. Therefore, CONSERVE SICILIA SRLS's acceptance of the purchase proposal submitted by the Customer is subject to the availability of the products in stock. CONSERVE SICILIA SRLS undertakes to promptly notify the Customer of any unforeseeable stock shortages due to excess demand or other causes.
6. CUSTOMER OBLIGATIONS
The Customer declares and guarantees: (i) to be a consumer as per Article 3 of the Consumer Code; (ii) to be of legal age; (iii) that the data provided by the Customer for the execution of the Contract are correct and truthful.
7. RIGHT OF WITHDRAWAL AND RETURN POLICY
7.1 – The Customer has the right to withdraw from the contract without penalty and specifying the reason (non-compliant product or other) within 6 days of receiving the products. The Customer may exercise the right of withdrawal within the aforementioned deadline by notifying the Customer by telephone or by written communication to the CONSERVE SICILIA SRLS headquarters referred to in Article 4, to be sent by registered letter with acknowledgement of receipt or by telegram, telex, email, or fax.
7.2 – Customers wishing to exercise their right of withdrawal must return the products to the address indicated on the invoice, following the instructions therein, within 6 days of receiving the products. Pursuant to Article 55, paragraph 2, of the Consumer Code, the Customer will not have the right of withdrawal in the following cases: – supply of sealed audiovisual products or software opened by the Customer; – supply of products packaged to order or personalized, or which by their very nature cannot be returned or are liable to deteriorate or expire rapidly (e.g., cosmetics, flowers, perishable foodstuffs); – supply of newspapers, periodicals, and magazines.
7.3 – The costs of returning the products are borne by the Customer. CONSERVE SICILIA SRLS will refund, within 7 days of the date of receipt of the products by the Customer: (i) the full price paid by the Customer in the event of a return of the product complete with all its parts and functions; or the portion of the price equivalent to the product actually returned by the Customer who has used the product in an appreciable manner and/or in a manner that significantly reduces its value.
7.4 – The refund by CONSERVE SICILIA SRLS to the Customer will take place using the same payment method with which the Customer initially paid for the order.
7.5 – If the product presents defects or is damaged, the procedure is as follows: it is necessary to send photographic proof of the product and the label with the batch number clearly visible and with the original packaging. CONSERVE SICILIA SRLS will proceed with the refund to the Customer using the same payment method with which the Customer initially paid for the order.
8. COMPETENT COURT
The Contract is governed by Italian law. Any disputes will be governed by current Italian law. The competent court is the Court of Catania.
